1.1. The service provider is Prague Stream s.r.o., ID number 17984556, with registered office at Perucká 2481/5, Vinohrady, 120 00 Prague 2, registered in the commercial register maintained by the Municipal Court in Prague, section C, file 379692 (hereinafter referred to as the "provider").

e-mail: info@praguestream.com,
Reservations, enquiries and questions: +420 792 759 529.
Management, marketing and cooperation: +420 775 571 119.
The provider is a VAT payer. VAT number: CZ17984556.
1.2. These general terms and conditions (hereinafter referred to as the "GTC") govern the negotiation and provision of private cruises with a captain, the use of vessels while moored and related services, in particular refreshments, drinks, service, decorations and programmes for private and corporate events. Additional rules for gift vouchers are contained in Article 15.
1.3. A customer is a natural or legal person who enters into a contract with the provider. A consumer is a natural person acting outside the scope of their business or independent profession. A participant is a person who takes part in an event or cruise.
1.4. The agreed content of the service is decisive. The designation "boat charter" on the website does not in itself mean handing over the vessel to the customer for independent navigation or operation. These T&Cs do not apply to bareboat charters.
1.5. General Terms and Conditions, including Appendix No. 1 "Price list of reimbursements for equipment and extraordinary cleaning" are part of the contract if the customer was familiarized with them before concluding it. An express individual agreement takes precedence over the GTC, but must be confirmed in writing by both parties in e-mail communication. The agreed content, the identity of the acting persons and the consent of both the customer and the provider, or their authorised representative, must be evident from the communication; the confirmation must be able to be stored and displayed repeatedly. A one-sided note or an unconfirmed customer request does not constitute an individual agreement. This requirement applies to individual agreements and changes to the contract, not unilateral exercise of a legal right, such as withdrawal or complaint. The mandatory legal rights of the customer are not affected.
2 Enquiry, provisional hold and conclusion of the contract
2.1. The customer can send a request via a web form, by e-mail or by phone. In the request, the vessel, date, time and length of the service, number of persons, requested accessories and contact and billing information will be indicated. Before submitting the web form, the customer can check and correct the information entered.
2.2. Submitting the form is a non-binding request. The mere acceptance of the request, the automatic message or the display of the free date do not constitute the conclusion of a contract or a binding confirmation of the voyage. The provider checks availability and whether the requested service can be provided.
2.3. A binding reservation of the date is created by the timely receipt of a deposit in the amount of 100% of the agreed price of the cruise or the separate use of the vessel while moored according to the provider's offer. In the case of a bank transfer, crediting the amount to the provider's account is decisive; in the case of a pre-arranged payment in cash, its acceptance by the provider and in the case of a pre-arranged payment by card, successful execution of the payment. The deposit must always be paid before the start of the event. Until the deposit is received, the system may provisionally hold the date for 72 hours from the successful establishment of the request. This is not a binding reservation. The customer will be shown or notified by e-mail when the provisional hold starts and exactly when it ends. For events requested less than 72 hours before the start, the provider will communicate a shorter payment period in advance. The payment period and the end of the block must be compatible with each other.
2.4. The provider will send the customer a specific offer specifying the service, date, number of people, total price, deposit, maturity, cancellation conditions and the period of validity of the offer. The relevant version of the General Terms and Conditions will be attached to the offer in an attachment enabling saving and repeated viewing, or they will state their full text directly in the e-mail. The link to the website can be attached in addition. The offer will clearly identify any changes from the customer’s enquiry. The customer must have the opportunity to become familiar with the conditions before payment. In particular, it will draw attention to the cancellation rules, possible contractual fines and cases in which there is no legal right to withdraw within 14 days. If the price list is sent separately, the provider will also attach the complete Annex No. 1 in the version valid for the given contract; the mere reference in the itinerary or the message on board does not replace familiarization before the conclusion of the contract.
2.5. By accepting the deposit according to Article 2.3, a contract for the agreed services and a binding reservation are created at the same time. A separate signed document is not required unless required by law or individual agreement. The offer must expressly state that accepting it by paying the deposit creates an obligation to pay the full agreed price of all services ordered. Neither the request itself nor the unpaid approval of the offer constitutes a binding reservation. Silence is not acceptance of an offer. Article 15 contains special rules for purchasing a voucher.
2.6. After receiving the deposit, the provider will send a confirmation of the agreed services and a binding reservation by e-mail without undue delay. The confirmation will state the date, price, deposit received, any balance due, and the payment and cancellation terms. It will include the full text of the applicable version of the GTC as an attachment or in the body of the message; a link to a changeable website alone is not sufficient. Mandatory contractual information must be provided to the customer in a text form that can be saved and retrieved. Manual entry of payment in the system is for record-keeping purposes only. Timely payment and the resulting reservation are not affected by late registration or incorrect automatic release of the date. If the price list is sent separately, the provider will also attach the complete Annex No. 1 in the version valid for the given contract; the mere reference in the itinerary or the message on board does not replace familiarization before the conclusion of the contract.
2.7. If the contract is not concluded within the specified period and the provisional hold has not been extended, the term will be released without a cancellation fee. A separate notification of the end of the provisional hold is not sent. In a specific offer, the provider can extend the provisional hold; its end and payment period must be mutually compatible.
2.8. Payment received after the offer has expired does not automatically entitle you to the original date. The provider will verify the availability and propose how to proceed. If no new agreement is reached, they will return the payment without undue delay, within 14 days at the latest.
2.9. The customer can send changes and corrections of data to the contact e-mail. Changes to an already concluded contract require written confirmation by both parties according to Article 1.5. The contract is concluded in Czech, or in another expressly agreed language. The provider stores the contract documentation electronically and will provide a copy of it to the customer upon request. The cost of long-distance communication is paid by the customer according to the normal tariff of their telecommunications provider; the provider does not charge a special communication fee.
3 Price and payment terms
3.1. Prices are given in Czech crowns. Consumer prices are final and include all applicable taxes and mandatory fees. The price of the offer accepted by the customer is binding. A later change to the web price list does not change the agreed price.
3.2. The deposit amounts to 100% of the agreed price of the cruise or the separate use of the vessel while moored and is included in this price. It is usually paid by bank transfer according to the payment details on the advance document or invoice; upon prior agreement, payment can also be made in cash or by card. The option to pay on the ship does not change the obligation to pay a deposit in advance for the formation of a binding reservation. The price of the ordered catering is payable before the start of the event, by transfer, cash or card as agreed. The price of drinks and other accessories, any advance payments and the due date will be stated in the offer; for continuously ordered consumption, the unit prices and billing method will be communicated in advance. The deposit itself is not a cancellation fee; its settlement is governed by Articles 7 and 8. Payments for vouchers are also governed by Article 15.
3.3. Additional services, additional persons in the permissible capacity, special boarding place, passage through a lock or extension can only be charged if the customer agrees in advance on their price or method of calculation. Special requests written in the note of the form are not automatically accepted.
3.4. Extension of the event is possible depending on the availability of the vessel, crew and operating conditions. Before the extension, the price and method of accounting for time will be negotiated. Only the customer and persons designated by him may order services on the customer's account. Other participants pay for their own orders, unless expressly agreed otherwise.
3.5. Any refundable security deposit must be negotiated before the conclusion of the contract, including the amount, purpose, withdrawal conditions and settlement date. These General Terms and Conditions do not in themselves constitute an obligation to post a deposit.
3.6. In the event of a delay in payment, the provider will ask the customer to pay and provide him with a reasonable additional period with a warning of the consequences of its failure. The next procedure is governed by the law and specifically agreed conditions. A valid contract does not expire by simply deleting the reservation internally.
4 Vessels, capacity and course of service
4.1. The maximum number of guests on the Houseboat is 16 while cruising and 25 while moored, and on the yacht Alexis it is 10 while cruising and 10 while moored. These capacities correspond to the approved vessel documents. Children are included in the number of guests. The crew is counted according to the approved documentation of the specific vessel; the permitted total number of persons on board must not be exceeded.
4.2. When combining an event while moored and a subsequent cruise, the number of people before departure must correspond to the capacity for the cruise. When ordering two vessels, the capacity is assessed for each separately; guests are not entitled to a joint stay of all persons on a single vessel above its limit.
4.3. The standard point of departure and arrival is Výtoň in Prague. The exact place and time will be communicated by the provider in the confirmation. Another place is only possible by agreement, depending on the possibility of a safe landing and for a pre-agreed price.
4.4. The customer will ensure the timely arrival of the group. A delay on the part of the customer does not in itself postpone the agreed end of the action. If the provider has kept the contracted vessel and crew ready, late arrival or early voluntary termination does not create an automatic right to a discount. Statutory rights due to negligence of the provider are not limited thereby.
4.5. If a certain route or stop is not an explicitly guaranteed part of the contract, the itinerary is indicative. The master can reasonably adjust it according to safety, traffic on the waterway and availability of locks. A fundamental change to the agreed performance shall be settled in accordance with Article 7.
4.6. Alexis yacht does not provide BBQ or DJ service. The availability of other services is governed by the confirmed offer. Transfers between ships take place only in a safe place according to the instructions of the crew.
4.7. The maximum negotiable cruise length is 11 hours. The cruise must always end no later than midnight; this time limit applies even if the agreed 11 hours pass later.
5 Safety and conduct on board
5.1. The captain decides on the safe departure, route, landing and possible interruption of the voyage. Participants must follow the safety instructions of the crew, use the prescribed protective equipment and not interfere with the steering, technical or safety equipment of the vessel.
5.2. The customer will hand over the safety rules received from the provider to the participants before the event. The provider will provide the necessary instruction on board. Minors are supervised by their legal guardian or an authorised adult; this does not affect the provider's obligation to ensure safe operation.
5.3. The customer communicates in advance the requirements that are essential for a safe boarding and stay, for example the need for assistance or suitable life jackets for the child. Before confirmation, the provider will assess the realistic possibilities of providing the requested service. There is no need to communicate diagnoses if they are not necessary to solve the request.
5.4. Without the consent of the crew, it is forbidden to enter the water, jump from the boat, handle fire or grill and enter inaccessible areas. Smoking and the use of e-cigarettes are only possible in places expressly designated by the crew, if permitted by law. Pyrotechnics, releasing decorations and throwing objects into the water are prohibited.
5.5. The captain or a member of the crew authorised by him may refuse to board or order to leave the vessel a person who is so under the influence of alcohol or other substances that he endangers safety, is unable to follow instructions, is aggressive or seriously disrupts the course of the event. If possible, warning and remedial measures are provided. Leaving the vessel will only take place after a safe landing in a suitable place and in a way that does not expose the person to foreseeable danger. In the case of refusal to cooperate, the police can be called, and in the event of a threat to health, the emergency medical service. This provision does not authorize the disproportionate use of force.
5.6. In the event of a serious threat, the captain can interrupt or end the entire event. The financial settlement is assessed according to the cause, the scope of the service provided and the law. This provision does not establish the automatic forfeiture of all payments or the liability of all participants for the actions of one person.
5.7. Storage, technical and other clearly marked non-public areas are inaccessible to guests. Entry is only possible with the express consent of the crew. The customer undertakes not to enter these premises without consent, not to allow others to enter, and to inform their guests of the prohibition. The exception is the necessary action to avert imminent danger, if it cannot be averted otherwise.
5.8. No garbage, toilet paper, wet wipes, hygiene items or other objects may be thrown into the ship's toilet. These are placed in the designated bin. Participants are obliged to follow the instructions and markings at the toilet and, in the event of a malfunction, stop using the toilet and inform the crew.
5.9. If the vessel is contaminated with vomit, the crew will assess the person's health, safety and ability to continue. Nausea alone does not constitute automatic disqualification. If at the same time the person seriously threatens safety or disrupts the course of the event, the procedure may be followed according to articles 5.5 and 5.6. Necessary assistance and a safe landing must always be provided. Financial claims are assessed according to Article 10; they are not an automatic consequence of a medical condition.
6 Refreshments, drinks, decorations and suppliers
6.1. Catering is provided by the provider in its own name, possibly through subcontractors, and is responsible to the customer for its proper provision. The scope and price of catering, drinks, service and decorations are part of the accepted offer or later agreed changes. If the customer concludes a separate contract directly with the supplier for another additional service, he will be explicitly informed in advance about his identity and the distribution of obligations.
6.2. Allergen information is available before ordering a specific dish and when it is served. The customer will notify special dietary requirements in good time. The provider will explicitly confirm which it can fulfil. Without such confirmation, the special request cannot be considered accepted. This does not limit responsibility for food safety and correctness of allergen information.
6.3. Alcohol will not be served to anyone under 18 or in any other circumstance in which its service is prohibited by law. Serving staff may require proof of age and refuse further service for safety reasons.
6.4. Own refreshments, drinks and external catering are possible by prior agreement. Any corkage or service fee must be communicated to the customer and agreed upon in advance. The customer is responsible for the condition of the food and drinks delivered by him until they are taken over by the provider. Each party is responsible for its own storage and handling; the provider does not thereby exclude its statutory hygiene obligations.
6.5. The date for the final number of portions, the choice of menu and the form of decorations will be agreed in the offer. Later changes are only possible by agreement. When pricing them, it is possible to take into account already purposefully spent, documented and non-refundable costs for the originally approved performance, after deducting savings and the possibility of further use. The customer receives the financial impact of the change before approving it. The same load cannot be charged twice.
6.6. Custom decorations and their fixing must be approved by the provider, they must not damage the ship or block passageways or safety equipment. The use of confetti, glitter, shooting confetti and similar items is subject to crew approval and safety rules; the special cleaning offer itself does not allow their use. The conditions of extraordinary cleaning and its price of CZK 3,000 including VAT for one event are listed in Article 10.14 and Appendix No. 1. This fee is not charged for ordinary cleaning.
7 Weather, sailing restrictions and changes by the provider
7.1. Normal rain, cloud cover or lower temperature are not in themselves grounds for free cancellation if the agreed service can be provided safely and properly. However, the provider may not use this provision to excuse the unfitness of the vessel or a fundamental deviation from the promised service.
7.2. If the provider cancels the event, it will inform the customer without undue delay and offer an alternative date. Cancellation may be necessary especially in case of dangerous weather, unsuitable water conditions, prohibition of navigation, technical incapacity or other obstacle to safe operation. Acceptance of an alternative date requires the agreement of the customer and the provider; if it is not concluded, payments will be settled according to Article 7.4.
7.3. Substitution of the agreed voyage with a stay while moored, exchange of a vessel with fundamentally different characteristics or any other substantial change requires the customer's consent. The customer is not obliged to accept a voucher, a different term or a substantially different service in lieu of a refund.
7.4. If the provider cancels the entire event and the customer does not accept an alternative, he will refund the payments for the cancelled performance without undue delay, no later than within 14 days. In case of partial non-provision of the service, the corresponding settlement of the unfulfilled part belongs to the customer; other legal rights, including withdrawal in the event of a material breach of contract, remain preserved.
7.5. Separately agreed and actually provided additional services are billed according to the agreement. Already incurred costs of subcontractors are not automatically transferred to the customer when the event is cancelled by the provider. Any damages are assessed according to law; The mere designation of an obstacle as force majeure does not establish the right to retain the price of the service not provided.
8 Changes and cancellation by the customer
8.1. Requests for changes or cancellations are sent by the customer to info@praguestream.com with the details that allow the reservation to be determined. For the contractual cancellation period, the decisive time is when the notice is received by the provider or a representative authorised to receive it. The Provider shall confirm acceptance without undue delay; his delayed response does not change the moment of delivery. The individual transfer or settlement agreement must be confirmed by both parties in accordance with Article 1.5. Statutory withdrawal is governed by Article 9 or 15 and the law; its effectiveness is not subject to the consent of the provider.
8.2. Changing the date, vessel, duration of the event, number of people or scope of services is subject to agreement and availability. Reducing the number of guests does not in itself reduce the price of the reserved vessel or the already bindingly ordered services. A higher number of guests is possible only after confirming the capacity and any additional payment.
8.3. If the customer announces the cancellation of the original date for personal or organisational reasons no later than 7 days, i.e. at least 168 hours, before the agreed start of the event, he has the right to transfer the paid price of the cruise to an alternative date. For this reason, the price of the cruise is non-refundable; the full amount will be used for the cruise on the replacement date. The parties will agree on an alternative date based on availability. The provider will offer realistically usable options in a reasonable time. No fee is charged for the date transfer itself; any change in the scope of the service and the price must be approved by the customer in advance. The rule applies similarly to a stand-alone event while moored.
8.4. If, for reasons on their part, the customer announces the cancellation at least 24 hours, but less than 168 hours before the agreed start of the event, a cancellation fee of 50% of the price of the reserved cruise or independent use of the vessel while moored is agreed. The fee will be set against the paid deposit and the remaining unspent part of the price will be returned no later than 14 days after delivery of the cancellation, taking into account clause 8.7. This rate does not apply to cancellation by the provider, justified legal withdrawal or any other reason for which the law requires a refund of the price. Transfer or other settlement can be arranged individually according to Article 1.5. If the provider cannot offer a realistically usable replacement date according to Article 8.3 and the parties do not agree on a solution, they will return the unused price of the service in question within 14 days. Mere rejection of all reasonable offers does not establish an automatic right to a refund. Additional services will be settled separately according to Article 8.5.
8.5. Catering, drinks, decorations and other additional services will be settled separately in the event of a move or cancellation according to the agreement. Any costs must be documented, purposefully spent and take into account savings and other uses. The same cost or damage cannot be charged twice. The billing must be understandable and any overpayment will be returned no later than 14 days after the settlement is determined; the provider will return the undisputed part without unnecessary delay even in the event of a dispute over the remainder.
8.6. If the event is cancelled for reasons on the customer’s side less than 24 hours before the agreed start, or in the event of a no-show, a cancellation fee of 100% of the price of the booked cruise or separate use of the vessel while moored will be charged. In the event of a no-show, this rule applies only if the provider was ready to provide the agreed service properly at the agreed place and time. The fee will be offset against the deposit paid. This rate does not apply to cancellation by the provider, a justified statutory withdrawal, or any other reason for which the law requires the price to be refunded.
8.7. The cancellation fee must not lead to an unreasonable disadvantage for the consumer. The settlement will take into account the significant actually saved costs and the income from the alternative use of the same term to the extent that prevents unreasonable compensation; any overpayment will be returned within 14 days of determining the settlement. Statutory consumer protection and the possibility of reasonableness review remain. Additional services will be settled according to Article 8.5. The same damage is not covered a second time by additional fines or damages. Free transfer in case of late cancellation can be arranged individually, for example, taking into account an emergency situation.
8.8. These rules do not limit free withdrawal or other claims that the customer is entitled to by law, especially in the event of a breach of contract by the provider.
9 Consumer withdrawal within 14 days
9.1. In the case of contracts for the leisure activities, meals or the rental of a means of transport, which are to be fulfilled on a certain date or in a certain period, the consumer does not have the right to withdraw without giving a reason within 14 days according to § 1837 letter j) of the Civil Code. These are mainly cruises and events booked for specific dates, events that meet these legal conditions. The purchase of a voucher without an agreed date of use is not automatically governed by this rule; see Article 15.
9.2. If a specific service has the legal nature of passenger transport, the special rules for that service apply; the general fourteen-day right to withdraw from a distance contract does not apply pursuant to Section 1840(h) of the Civil Code.
9.3. Exceptions cannot be automatically applied to any service or goods offered by the provider. If the specific performance does not fall under the exception, the provider will provide appropriate instructions and a sample form for withdrawal before concluding the contract. Legal rights from defective performance or failure to perform the agreed service remain preserved.
10 Damages and personal belongings
10.1. The provider is responsible for the proper provision of the agreed services and for damage to the extent stipulated by legal regulations. These GTC do not exclude or limit liability where the law does not allow it, especially for damage to the natural rights of a person, damage caused intentionally or due to gross negligence, or the legal rights of the weaker party.
10.2. The customer and participants are responsible for damage according to legal conditions. The mere ordering of the event does not establish the customer's unlimited liability for all actions of all guests. Normal wear and tear is not covered.
10.3. The provider has the right to compensation against the responsible person for proven damage caused to the vessel and its equipment under legal conditions. For both Houseboat and Yacht Alexis, Appendix No. 1 and the rules in Articles 10.11-10.14 apply. The tabulated amounts are the basis for calculating the actual damage, not an automatic fine for damage. The usual price of the item at the time of damage, its previous condition and what must be spent to restore or replace its function will be taken into account. Normal wear and tear is not covered. The provider documents the damage and documents responsibility, the amount of the claim and the causal link.
10.4. Participants take care to protect personal belongings, especially phones, glasses and electronics from falling into the water. This recommendation does not exclude the statutory liability of the provider for items taken over or left behind or for damage caused by his actions.
10.5. A contractual fine of CZK 5,000 per individual violation is agreed upon for violating the ban on entering the storage area according to Article 5.7. It applies only to the customer who has expressly accepted this sanction and has himself violated the secured obligation. In the case of a legal entity, the actions of persons are attributed according to the law. The mere participation of another guest does not establish his contractual obligation to pay a fine or the client's automatic debt for his actions.
10.6. With regard to the fine according to Article 10.5, the parties expressly agree that its payment does not affect the provider's right to compensation for proven damage caused by the same violation in full, and to this extent they deviate from § 2050 of the Civil Code. Damage compensation is not another flat fee; liability and its amount must be proven. The same damage cannot be compensated repeatedly.
10.7. A contractual fine of CZK 3,000 is negotiated for proven clogging of the toilet by violation of the prohibition according to Article 5.8. The fine will not be applied for a common technical defect, wear and tear or blockage, the connection to which the prohibition is not documented. The same conditions of explicit acceptance and designation of the liable person apply as in Article 10.5. For the same violation, in addition to this fine, the provider does not charge an additional flat fee for removing the provisional hold; the relationship to damages is governed by § 2050 of the Civil Code.
10.8. In the case of culpable pollution of the vessel by vomit, which is a demonstrable consequence of a breach of the agreed obligation not to endanger hygiene and safety by excessive consumption of alcohol or other similar culpable conduct, a contractual fine of CZK 3,000 is agreed. It does not apply to a common medical indisposition or to a case where the breach of duty and its connection to pollution have not been proven. The same conditions of explicit acceptance and determination of the liable person apply as in articles 10.5 and 10.9. For this violation, the parties agree to compensate the proven damage only to the extent exceeding the fine; the fine already paid will be counted towards the compensation of the same damage. In this way, they deviate from § 2050 of the Civil Code to the extent indicated. Proportionality and statutory consumer protection remain.
10.9. Fines according to articles 10.5–10.8, including the concurrent fine for entering the storage area and compensation for damage, must be clearly presented to the customer and expressly accepted before the conclusion of the contract, for example by separate confirmation of their specific wording in the ordering process or by e-mail. Mere placement in the General Terms and Conditions on the website is not sufficient to negotiate them according to these General Terms and Conditions. The demand for payment shall indicate the breached obligation, the responsible person, the documents and the amount; due date is 14 days from delivery. Statutory protection of the consumer against unreasonable sanctions and the possibility of judicial review are not affected.
10.10. The provider will notify the detected damage and claim against the responsible person without undue delay, usually no later than 30 days after the damage was discovered. The notification contains a description, available documentation and the amount of the claim, or a preliminary estimate pending receipt of the estimate of the repair. A later finding does not in itself prove that a particular customer caused the damage. The said organisational period does not establish a new statutory period for compensation of damages or extend the statute of limitations; legal deadlines remain.
10.11. Repairable damage is based on reasonable repair costs. In case of complete destruction or loss of the item, the unit amounts in Appendix No. 1 serve as a basis for determining compensation according to Article 10.3; the number of pieces in the item name does not mean the price of the whole set. Items marked "Individual" and other damages are calculated according to the documented scope and appropriate costs. The cost of repair is part of the actual damage; the same damage cannot be charged at the same time as repair and full replacement of the item. Houseboat tables are not transferable to Yacht Alexis, except for the common rates expressly stated in the Appendix.
10.12. For both vessels, in addition to the actual damage, demonstrable lost profit can be claimed in causal connection with the damage event, for example from specific actions that could not be carried out during the necessary repair period. The lost profit is not automatically the full price of the cancelled promotion or a multiple of the daily rate; the costs that would have been necessary to achieve the return and that were saved by not carrying out the action are taken into account. It must be documented that the profit would be achieved in the ordinary course of business, even the necessary duration of the restriction of operation. The provider will take reasonable measures to mitigate the damage. The same damage is not covered twice; the concurrence with the contractual penalty is governed by the express rules of articles 10.6–10.9 and the law.
10.13. The participant shall immediately notify the crew of damage or loss. The provider will give the responsible person a written calculation with a description of the event, extent of damage, available photos or other evidence and documents for repair, replacement of the item or lost profit. The calculation itself is not an acknowledgement of debt by the customer or proof of his liability for other guests. When calculating the compensation, VAT is taken into account to the extent that the provider actually bears its cost; deductible VAT is not included in the damage.
10.14. For extraordinary cleaning after the use of confetti, glitter, shooting confetti or similar decorations, CZK 3,000 including VAT can be charged for one event, if the pollution requires cleaning beyond the normal scope and this service and its price have been expressly agreed by the customer before the decorations are used. The extent of contamination shall be documented. The fee is charged for the same action only once for the vessel concerned and covers this extra cleaning; the same costs are not again included in the damages. Separate damage to the equipment is billed according to the legal rules and Appendix No. 1. If cleaning is not agreed as a paid service, any claim will be assessed according to documented responsibility for the damage; the price list itself does not establish an automatic sanction or unlimited liability of the customer for all guests.
11 Complaints
11.1. The customer can complain about a defective service provided by e-mail to info@praguestream.com, in writing at the provider's headquarters or in person to an authorised employee during the service. Complaints are also accepted at the establishment, where their acceptance is possible according to the law.
11.2. It is advisable to report the defect to the crew immediately during the cruise, so that they can ensure correction, and then describe it in writing to info@praguestream.com, ideally within 24 hours of the end of the cruise. This is a recommended procedure for quick clarification and securing of evidence, not a period after which the right to complain expires. A complaint that has already been filed does not require a repeated written submission to be valid. The customer states the reservation, description of the defect, the desired method of correction and contact details.
11.3. The provider will issue a written confirmation to the consumer about the date of application of the claim, its content, the required method of settlement and contact details for informing about the result. The provider decides on the complaint immediately, in complex cases within three working days; this period does not include the reasonable time required for a professional assessment of the defect.
11.4. The consumer's complaint, including the removal of the defect, will be processed and the consumer will be informed of the result within 30 days of the claim at the latest, unless they individually agree on a longer period. The provider will issue a confirmation of the date and method of settlement, or a written justification for the rejection. After the legal deadline has expired in vain, the consumer can withdraw from the contract or demand a reasonable discount.
11.5. Depending on the nature of the defect and the legal conditions, the customer may request a remedy, a reasonable discount or withdraw from the contract. In the case of a justified complaint, he is also entitled to compensation for the costs incurred for its application. For business customers, rights from defects are governed by the contract and the Civil Code; the statutory consumer period of 30 days does not automatically apply to them.
12 Out-of-court settlement of disputes
12.1. In the event of an unresolved dispute arising from the contract, the consumer may turn to the Czech Trade Inspection, the subject of out-of-court settlement of consumer disputes. Information and access to submitting a proposal are available at https://coi.gov.cz/informace-o-adr/.
12.2. The proposal can be submitted no later than one year from the date on which the consumer exercised the right that is the subject of the dispute with the provider for the first time. This does not affect the possibility of going to court.
13 Personal data
13.1. The provider processes personal data to the extent necessary to process the request, conclude and fulfil the contract, fulfil legal obligations and protect legitimate interests. Details, retention periods and rights of data subjects are set out in the separate information on the processing of personal data available on the website and before submitting the form.
13.2. Agreeing to the GTC is not consent to sending marketing or publishing identifiable photos of participants. Marketing consents are separate and voluntary; the legal option to address customers with their own similar services is only used when the relevant conditions are met. For the advertising use of recognizable persons, the provider will ensure appropriate individual permission and possible consent to data processing. By accepting the GTC, the customer does not give consent to the image on behalf of other guests. Refusal of marketing or photography does not prevent ordering the service.
14 Final Provisions
14.1. The contract is governed by the law of the Czech Republic. The choice of law must not deprive the consumer of the protection granted by the binding provisions of the law that would otherwise apply. The legal rules of jurisdiction are not changed by these GTC.
14.2. For a specific contract, the version of the GTC submitted before its conclusion and incorporated into the contract applies. Later updates of the web GTC no longer unilaterally change the concluded contract.
14.3. These GTC take effect on 1 October 2026.
15 Gift vouchers
15.1. The provider offers value vouchers or vouchers for a specific service. Before the purchase, they will inform you of the price, content or value, period of validity, method of delivery and application, transferability and any restrictions. The individually stated conditions may not limit the legal rights of the consumer.
15.2. The purchase of a voucher is created by accepting its payment on the basis of a specific offer, if no other moment of conclusion of the contract is explicitly specified in the ordering process in advance. After payment, the provider will deliver the voucher in the manner specified in the offer and confirmation of the contract in a storable text form. The voucher in itself does not reserve a specific sailing date, unless this date has been expressly agreed upon.
15.3. The voucher holder must agree the date of use in advance, subject to availability. In the case of a value voucher, its value is credited towards the agreed price; any additional payment will be stated in the offer. For a voucher for a specific service, the scope is governed by the text of the voucher and the accepted offer; a later change in the price list does not in itself change the already purchased range. The provider will explicitly describe the arrangement of a binding reservation, the use of a voucher instead of a deposit payment, and the cancellation of such a reservation before confirming the date.
15.4. In the case of a distance purchase of a voucher without a fixed date, the provider grants the consumer the right to withdraw without giving a reason within 14 days of concluding the contract. Electronic sending of the voucher itself does not invalidate this right. In the case of a voucher, with which a specific term of service falling within the statutory exception is already bindingly agreed upon at the time of purchase, the provider will explicitly state the reason for not exercising this right before the purchase. The application of the service during the withdrawal period must be resolved according to the nature of the actual performance and the law; simply ticking the box to agree to the delivery of the voucher is not enough.
15.5. Withdrawal can be notified by a clear statement to info@praguestream.com or in writing to the headquarters. Send the notice within the legal deadline. The consumer can use this form, its use is not mandatory: "Addressee: Prague Stream s.r.o., Perucká 2481/5, 120 00 Praha 2, info@praguestream.com. I hereby announce that I am withdrawing from the contract for the purchase of the voucher [designation or number], concluded on [date]. Name and surname of the consumer: [fill in]. Address: [fill in]. Date: [fill in]. Consumer’s signature, only for submissions on paper: [to be added]."
15.6. In the event of a valid withdrawal, the provider will return the funds received no later than 14 days after delivery of the withdrawal notice, using the same payment method unless the consumer expressly agrees to another method at no additional cost. The voucher will be cancelled. Outside the statutory right of withdrawal, exchanges or returns are governed by the terms communicated in advance and by agreement; this does not affect any right to a refund granted to the customer by law.

Determination and calculation of damages
The tabulated amounts serve as a basis for determining compensation in the event of total destruction or loss of an item. The compensation corresponds to the actual damage and takes into account the usual price of the item at the time of damage, its condition and the purposefully incurred costs of restoring or replacing its function. Repairable damage is based on reasonable repair costs. Normal wear and tear is not charged.
For both the houseboat and the Alexis yacht, compensation for the actual damage can be calculated, including reasonable repair costs, as well as provable lost profit arising in causal connection with the damage. Repair costs are part of the actual damage and are not double billed.
For flooring and other equipment marked "Individual", the compensation is determined according to the documented extent of the damage and the reasonable costs of its removal. Damage or loss must be reported to the crew immediately. The operator documents the event and gives the responsible person a written estimate with supporting documents. The same damage is not charged at the same time as repair and full replacement of the item.
Extraordinary cleaning after the use of party decorations
For extraordinary cleaning and cleaning of the boat, CZK 3,000 including VAT is charged for one event, if the use of confetti, glitter, shooting confetti or similar celebratory and decorative items causes pollution, the removal of which requires cleaning beyond the normal scope. These are mainly small particles caught in the upholstery, joints or in several places of the boat, which cannot be removed by ordinary quick cleaning.
The fee is charged only once for the same action. Any damage to the equipment will be billed separately according to this price list; the cost of the same cleaning is not included in the damage compensation again. The use of these items is governed by the ship's safety rules and crew instructions.
